This legal notice applies to the entire content of this website and to any correspondence between us and you. Please read these terms carefully before using this website. Using this website indicates that you accept these terms regardless whether or not you choose to purchase from us.

2. ORDER PROCESSING AND PAYMENT
Payment can be made by any of the methods indicated on the flowers payment page of the website and the money will be debited when you submit your order. When you submit your order by clicking on the ['Proceed To Payment’] button, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and Delivery Terms and Conditions that appear on this website.
For your order to be processed and delivered on the required date, you must supply us with all the relevant details requested, including full delivery details, post code and telephone number. Your order will only be processed if full payment details are given.
Your order will be acknowledged via e-mail confirming your details, if you enter a correct e-mail address. You will be issued an order reference number for any future correspondence. All costs will be charged at the cost of the date on which you place your order.
We will not consider ourselves bound by a contract with you until we have issued an email confirming your order.
3. PRODUCTS
All products are subject to availability, and acceptance of your orders. We reserve the right to change all or some of the contents or packaging with an item of equal or greater value without notice. Flowers may be delivered in bud to ensure longer life. Some flower bouquet contents may be harmful if eaten and/or a skin irritant. Please call our shop at the number given above if you wish to enquire about the safety of contents before ordering.
All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality without notice.
Products are delivered next day unless other delivery date or service is selected. Selected products are not available for same day delivery or other special delivery services. Further information regarding product availability and delivery options will be presented when placing your order.
4. DELIVERY PRICES
Next day delivery charges £3.95. These are delivered Monday to Saturday.
Same day delivery charges £4.95. This service requires you place your order before 12 noon. We offer a same day delivery service Monday to Friday.
Delivery prices include VAT
5. DELIVERY
Should the recipient be away at the time of delivery, a card will be left stating attempted delivery was made. The delivery driver may at their own discretion, leave with a neighbour or other safe place, however the recipient may have to collect the flowers.
Delivery is not available on Sundays or public holidays, orders will be delivered on the next working day.
Please ensure that you enter full and accurate details, including the address and the postal code, of the recipient. We will not be responsible for any orders which are not delivered due to incorrect or incomplete information being supplied by you.
Please note that we only deliver flowers & plants locally (please see our delivery areas on our deliveries & returns page).
We cannot guarantee an exact delivery time. We endeavour to deliver your order on the day specified at the time of ordering from Monday to Saturday 8am to 5pm.
Purchases of gifts containing alcohol may only be made and received by persons of 18 years or over. We reserve the right to refuse any sale at our discretion.
Except on special dates, our delivery service is NOT available on Sundays or UK public holidays or the day after a public holiday. Where orders have been placed for delivery on any of these dates and we are unable to contact you in time, we will deliver, where possible, the flowers the day before or the day after that date requested.
All deliveries made to hospitals must include the ward name and or number in the relevant address field. Any order omitting these details may not be accepted for delivery by the hospital.
In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, hotels and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. Please be advised that some products are unsuitable for delivery to Funeral Directors, Hospitals, airports or ships – please contact us for further information using the contact details set out on out ‘contact us’ page
Please note that the carrier is only responsible for delivering to the address you quote (or to a neighbour if no one is at home) we regret that where the goods have been correctly delivered, we cannot accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual receiver refuses or fails to return item(s).
Please note that where the carrier is unable to find someone to accept delivery, or unable to leave the delivery in a secure location, they will leave a card at the address for the recipient to make contact and re-arrange delivery. If the recipient fails to make contact in good time we reserve the right to charge for re-delivery to that or an alternative address.

6. PERSONAL MESSAGES
You must agree that any messages posted by you on your card or sent by us on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or are otherwise unlawful or objectionable.
You are entirely responsible for any text or other material which you post or send on this message system and The Flower Shop accepts no liability for any such content. We do not pre-screen messages, but may monitor content from time to time. We have the right to refuse to send or display messages and terminate access to the relevant Services at any time and without liability to you in the event of any such objectionable message.
7. CUSTOMER SERVICES
Because of their perishable nature, flowers are non-returnable. This does not affect your statutory rights. If you are not completely satisfied with your bouquet please call our shop on 01924 260496 from 8.30am to 5pm, Monday to Friday, quoting your order reference number or email [email protected]
In order for us to resolve any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 24hours of the date of delivery or intended delivery of your purchase.
8. DELIVERY FAILURE
Neither we, nor any delivery service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.
9. CANCELLATION
If, for any reason, you wish to change or cancel your order you can do so by calling 01924260496 or emailing [email protected]
Please give 48 hours notice before the requested delivery date.
We regret that you may not cancel an order for perishable food products once your order has been dispatched.
You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

Our customer services team is available from 8.30am until 5pm monday to friday and 8.30am until 3.00pm on saturday.
Because of the perishable nature of most products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase.
11. DISCLAIMER
Whilst we agree to use all reasonable endeavors to ensure that the online site and is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the online site and/or the florists online service and shall be released from our obligations under these terms and conditions in the event of any cause beyond our reasonable control which renders the provision of the online site impossible or impractical.
12. GENERAL
We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Site and/or the Service from time to time. We will post any changes on the Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Service or Site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
Additionally, we reserve the right to suspend, restrict or terminate access to the Site and/or the Services for any reason at any time.
These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.
A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the permission of The Flower Shop Ossett. My Account service – terms and conditions
1. My Account service (‘the Service’) is provided as a complimentary feature by Florists Online for your personal use subject to these Terms and Conditions. In order to provide the Service, we will hold certain personal information. Except to the extent that we are required or permitted by law, any personal information which we collect will be used solely for the purposes of providing the Service.
2. To register with the Service you must be over eighteen years of age.
3. When you register with the Service you will be required to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Should you forget your password, please use the password reminder service (this option can be found adjacent to the My Account login box).
4. If we have reason to believe that there is likely to be a breach of security or misuse of the Service or site, we may require you to change your password, or may suspend use of the Service.
5. You must ensure that the details you provide on registration or at any time are correct and complete.

12. We have obligations in relation to your personal information under the Data Protection Act 1998. Some of the information you provide may be “sensitive” information under the Act (i.e. information on “delicate” matters, including race, political opinions, religion, trade union membership, physical or mental health or condition, sexual life etc). By registering for the Service and providing your details, you agree to us using information in the way set out above. WEDDING BOOKINGS TERMS AND CONDITIONS
1. Booking Fee
When a wedding date is booked, we charge a £25.00 non-refundable Booking Fee. This saves the date for you. If, for any reason you decide to cancel your wedding this deposit is non-refundable. If you decide to postpone your wedding, we will hold your deposit until your wedding goes ahead. The £25.00 booking fee is subtracted from your final wedding invoice. Payment of your booking fee is an acknowledgement of Terms and Conditions.
2. Quotation and Payment
No wedding or event is booked until the booking fee has been paid. Quotes are valid for 30 days. Once the booking fee has been paid then the date is secure.
A quotation for the cost of your wedding flowers will be sent to you after the initial consultation, this is a guide price as you may make changes closer to the wedding day in terms of type of arrangement and quantity. You will receive a final invoice approximately 2 weeks before your wedding if payment has not already been received for your wedding. Payment is accepted by card, cash or direct payment via internet banking.
Payment in full is required at least 14 days before the wedding.
3. Cancellations
In the event of cancellation, the booking fee will not be refunded. Complete cancellation of the wedding must be advised in writing.
Cancellation 6 months prior - Loss of Booking Fee
Cancellation 6 - 3 months prior - 25% of total balance is still required to be paid
Cancellation 3 - 0 months prior - 50% of balance is required to be paid
4. Availability of Flowers
The options are that you can leave us to choose a mix of flowers, - or we will work to a colour and style palate, based on our discussions, emails and photos that you send in. Please note that we never produces absolutely identical designs to the photos that you send in, these are used as inspiration. Mother nature can play havoc with fresh flowers at times, should a flower become unavailable we reserve the right to substitute it with another suitable flower. Similarly, if any flowers are delivered to the shop that are damaged or below our normal standard we will not use these and a substitute will be used
5. Delivery
Any queries must be raised within 30 minutes of delivery your flowers by telephoning 01924 260496
6. Hire/use of vases, crates etc
We charge a refundable deposit of £50 for this service. Containers must be returned to The Flower Shop within 3 days, - or as agreed prior to your wedding.
Charges will be made for any items returned cracked, chipped or broken. Replacement of goods is charged at the current purchase price, it is then the responsibility of the hirer to reclaim any of these costs from the venue if the venue was at fault.
All equipment hired remain the property of The Flower Shop at all times.
7. Photographs
The Flower Shop reserves the right to take photographs of flowers and the setting prior to the wedding which may be used for promotional purposes.
8. Responsibility
The Flower Shop accepts no liability for injury, loss or damage to the hirer or any third party of any equipment hired for use at the event.

12. We have obligations in relation to your personal information under the Data Protection Act 1998. Some of the information you provide may be “sensitive” information under the Act (i.e. information on “delicate” matters, including race, political opinions, religion, trade union membership, physical or mental health or condition, sexual life etc). By registering for the Service and providing your details, you agree to us using information in the way set out above. Where you provide information about other people (for example their date of birth, or their address) you also confirm that have the consent of these people to provide us with that information.
WEDDING BOOKINGS TERMS AND CONDITIONS
1. Booking Fee
When a wedding date is booked, we charge a £25.00 non-refundable Booking Fee. This saves the date for you. If, for any reason you decide to cancel your wedding this deposit is non-refundable. If you decide to postpone your wedding, we will hold your deposit until your wedding goes ahead. The £25.00 booking fee is subtracted from your final wedding invoice. Payment of your booking fee is an acknowledgement of Terms and Conditions.
2. Quotation and Payment
No wedding or event is booked until the booking fee has been paid. Quotes are valid for 30 days. Once the booking fee has been paid then the date is secure.
A quotation for the cost of your wedding flowers will be sent to you after the initial consultation, this is a guide price as you may make changes closer to the wedding day in terms of type of arrangement and quantity. You will receive a final invoice approximately 2 weeks before your wedding if payment has not already been received for your wedding. Payment is accepted by card, cash or direct payment via internet banking.
Payment in full is required at least 14 days before the wedding.
3. Cancellations
In the event of cancellation, the booking fee will not be refunded. Complete cancellation of the wedding must be advised in writing.
Cancellation 6 months prior - Loss of Booking Fee
Cancellation 6 - 3 months prior - 25% of total balance is still required to be paid
Cancellation 3 - 0 months prior - 50% of balance is required to be paid
4. Availability of Flowers
The options are that you can leave us to choose a mix of flowers, - or we will work to a colour and style palate, based on our discussions, emails and photos that you send in. Please note that we never produces absolutely identical designs to the photos that you send in, these are used as inspiration. Mother nature can play havoc with fresh flowers at times, should a flower become unavailable we reserve the right to substitute it with another suitable flower. Similarly, if any flowers are delivered to the shop that are damaged or below our normal standard we will not use these and a substitute will be used
5. Delivery
Any queries must be raised within 30 minutes of delivery your flowers by telephoning 01924 260496
6. Hire/use of vases, crates etc
We charge a refundable deposit of £50 for this service. Containers must be returned to The Flower Shop within 3 days, - or as agreed prior to your wedding.
Charges will be made for any items returned cracked, chipped or broken. Replacement of goods is charged at the current purchase price, it is then the responsibility of the hirer to reclaim any of these costs from the venue if the venue was at fault.
All equipment hired remain the property of The Flower Shop at all times.
7. Photographs
The Flower Shop reserves the right to take photographs of flowers and the setting prior to the wedding which may be used for promotional purposes.
8. Responsibility
The Flower Shop accepts no liability for injury, loss or damage to the hirer or any third party of any equipment hired for use at the event.
